While it may have become legal to use and grow marijuana in California, thanks to Proposition 64, the law does come with certain terms and conditions.
Marijuana still cannot be smoked in public places, unless allowed by a local ordinance. Tobacco smoking restrictions also apply to marijuana– if a place bans tobacco smoking, marijuana smoking is banned as well.
What’s allowed and what’s not?
The state allows people ages 21 and above to use, possess and share cannabis, as well as grow it at home. Adults can transport and buy up to an ounce of marijuana for recreational use. But they will not have a place to legally buy nonmedical marijuana until stores are licensed; licenses will begin to issue on January 1, 2018. People smoking marijuana in public can be fined up to $100. Those caught smoking pot in prohibited zones or near a school building, day care, or youth center should be ready to pay fines up to $250.
A warning: cannabis is still illegal under federal law.
How can businesses clear the air?
You can clear any confusion for employees or patrons by posting explicit Marijuana Smoking Signs. The new law gives the right to employers to maintain a drug- and alcohol-free workplace, test employees for marijuana intake and prohibit use during work hours.
Simple notices leave no room for confusion about your marijuana policy.
